Brief description: The project segment "Awarding Public Contracts to Social Enterprises" focuses on Europe's law regulating public procurement. It examines its legal foundation to determine to what extent the consideration of social interests by social enterprises can factor into the decision-making process of public agencies while allocating contracts. Various legal levels will be examined:
- the interpretation of procurement criteria by the ECJ and by the courts of European member states,
- the legal practice of procurement inspection authorities and procurement chambers as well as
- German jurisprudence regarding the public procurement law and
- the prevailing regulatory framework as specified by § 97 Sect. 2 of German antitrust law
A sample legislation proposal and a procurement guidebook will be drawn up for social enterprises.
